The CCML changed course in June 1964 after observing the messy and time-consuming battle in the Advisory Committee over its proposed amendments to the FRCP joinder rules—especially Rule 23, the source of the modern opt-out class action.

He goes on to state that the unsealing of the evidence used to obtain the warrant "will confirm that any probable cause for this search warrant was predicated on either one or more individuals providing false information to law enforcement or a misapplication of the law" in his joinder motion.
